Foreign Employees and Social Insurance

Question: Even if they are enrolled in their own country, do we have to enroll our foreign employees in Japanese social insurance schemes?

Answer: Yes!

  By law, residents of Japan, regardless of country of citizenship, must be enrolled in social insurance schemes.
  This means that in most cases, foreign employees will be dual enrolled. However, foreign residents from countries that have an agreement with Japan can qualify for an exemption from the system in their home country if they meet certain requirements.
  Regardless of agreements, if and when a foreign resident stops residing in Japan and meets certain requirements, they can apply for a partial refund.

In our last blog, we talked about what “resident” and “non-resident” mean in terms of Japanese tax law. Let’s review below.

Resident
  Resident is defined as anyone who resides or owns a residence in Japan for a year or more. This means for example that if someone from a foreign country comes to Japan with a one-year working contact, they are considered a resident from the moment they come to the country. So they should be enrolled in social insurance from day one.

Non-Resident
  Non-resident is defined as everyone who doesn’t fit in the “resident” category. Non-residents do not qualify for Japanese social insurance, including health insurance, so we highly recommend private travel insurance to cover their stay in Japan.

外国籍の方と社会保険の加入について

Question:  外国籍の従業員を採用した場合には、日本の社会保険に加入させなければなりませんか?

Answer:  はい!
国籍に関係なく、事業所で常時使用される従業員(居住者)加入が義務付けられています。
したがって、外国籍の方は日本と自国の2つの国で社会保険制度に加入する事になる場合があります。
ただし、二重加入になってしまう方のうち、日本と社会保障協定を結んでいる国籍の方は、条件を満たせば、自国の社会保障制度の加入が必要なくなります。
一方で、社会保障協定に関係なく日本の社会保険を脱退し帰国する場合には、一定の手続きを行うことにより脱退一時金を請求することができます。

それでは、前回紹介した税務上の居住形態「居住者」と「非居住者」の視点でみてみましょう。

→ 居住者とは
居住者とは、国内に住所を有しているか、又は現在まで引き続いて1年以上居所を有する個人をいいます。居住者はさらに永住者及び非永住者に分かれます。
例えば、契約期間が1年間だとすると、1年以上滞在する予定になるので、来日した時点から居住者として考えられます。従って社会保険に加入する必要があります。

→ 非居住者とは
非居住者とは、居住者以外の個人をいいます。
非居住者は日本の社会保険に加入できませんので、滞在期間をカバーする社会保険相当の旅行保険への加入がおすすめです。
